AOBs are a legal tool by which a third-party obtains some (or all) of the benefits due and owing to an insured under an insurance policy. AOBs have been used for many years, but it was not until the May 2012 hail storms that insurers saw a significant rise in their use in the Commonwealth of Pennsylvania. Contractors retained by policyholders to repair damaged property included language in their contracts that allowed the contractors to stand in the shoes of the policyholder and seek payment directly from the insurance carrier. Statistics from other jurisdictions suggest a link connection between AOBs and the amount/severity of claims. Even though Pennsylvania allows AOBs, often those are being used incorrectly or are unenforceable as written. The purpose of this webinar is to identify not only the potential pitfalls associated with AOBs, but to offer practical solutions to assist insurance carriers with their investigation and handling of matters were AOBs are used.
About the Presenters:
Michael Zimmerman has over 30 years in the insurance industry. Mike oversees a 23 person claim department handling claims in eight different states. He is president elect of the Pennsylvania Dutch Chapter of the CPCU and serves on the PAMIC Claims Committee.
Scott Rybny of Timoney Knox. Scott is a member of the firm’s Insurance Industry Law Group, representing insurance carriers directly for his entire 18 year career. His practice has a particular substantive focus on property insurance, including both residential and commercial insurance. His experience also encompasses commercial general liability, D&O, fiduciary, commercial crimes and credit risk insurance. In addition to being a frequent presenter at PAMIC, Scott has also appeared as a paneling in seminars sponsored by the Insurance Society of Philadelphia, The Pennsylvania Defense Institute, the Defense Research Institute.
