The Restatement of Law – Liability Insurance. If you have not heard of this before, it will certainly become part of your vocabulary in the near future. But what is it and why should insurers take notice? Join attorneys Scott Rybny and Dick DiBella as they discuss the development of this important document, which some commentators deemed a misstatement of law. This webinar will explore the American Law Institute’s (“ALI”) recent adoption of the Restatement of Law – Liability Insurance during its May 21, 2018, Annual Conference. The ALI holds this document out as a summary of the law on liability insurance throughout the country. However, it adopted many policyholder friendly rules from a minority of jurisdictions that conflict with many long-standing insurance principles in Pennsylvania.

Member companies need to take notice of this Restatement as it has the potential to reshape both first and third-party insurance law in Pennsylvania.

This one hour webinar will focus on the most significant aspects of the Restatement of Liability Insurance for the claims professions including:

  • Policy interpretation including the ALI’s belief that extrinsic evidence should be used;
  • Third-party defense considerations where coverage issues exist; and
  • The “reasonable person in the position of the insured” standard for Reservations of Rights.

About the Presenters:

Scott C. Rybny of Rebar Bernstiel has been representing insurance carriers directly for his entire 18 year career. His practice has a particular substantive focus on property insurance, including both residential and commercial insurance. His experience also encompasses commercial general liability, D&O, fiduciary, commercial crimes and credit risk insurance. In addition to being a frequent presenter at PAMIC, Scott has also appeared as a paneling in seminars sponsored by the Insurance Society of Philadelphia, The Pennsylvania Defense Institute, the Defense Research Institute.

Richard W. DiBella is a shareholder and Vice-President at DiBella Geer McAllister & Best, P.C. He is a 1973 graduate of Pennsylvania State University, where he earned a Bachelor of Arts degree in English, Cum Laude. Richard DiBella earned his Juris Doctorate from the Duquesne University School of Law in 1976. Richard’s practice focuses on insurance litigation, civil litigation, arson and fraud defense litigation and bad faith litigation. He was a founding member of DiBella Geer McAllister & Best, P.C., in 1995, then known as DBella & Geer, P.C. Richard has over 42 years of practice devoted to the handling of property-related insurance claims, including fraud, arson, coverage, subrogation and related issues.
